General Liability

Oregon Health & Science University’s general liability policy covers damages and legal defense costs for bodily injury, personal injury (libel, slander, or defamation) or property damage to third parties for which the University is legally responsible. The policy covers University activities worldwide. Employees are covered on an individual basis subject to policy terms and conditions.

Liability claims or potential liability claims, should be reported to the Risk Management Department immediately. An injured person or someone with damaged property may be expecting OHSU to contact them. DO NOT DELAY in informing Risk Management of the liability or potential liability claim.

Liability claim or potential liability claim process:

Step 1: When you contact Risk Management regarding the liability claim, or potential liability claim, please forward the following:

  • A copy of the completed Incident Report
  • Copies of applicable letters, police reports, orders, rules, the Motor Vehicle Division’s Traffic Accident and Insurance Report, original photographs, and any other materials relating to the claim.
  • Witnesses and involved parties’ names, addresses, and phone numbers.
  • The lawsuit, if you were served. Write on the summons when it was received in your office and by whom. Call Risk Management at (503) 494-7189 immediately. Send Risk Management a copy of the summons and complaint.

Step 2: Risk Management will investigate and resolve the claim. Do not discuss the claim with anyone except Risk Management staff or our designated representative. Do not take any actions to resolve a claim without talking to Risk Management. If an urgent matter presents itself, contact Risk Management immediately.

Risk Management will work with your department to establish the value of the loss. The current process for reimbursement is to have the department involved with the liability claim to purchase the replacement equipment or pay for the repair of the equipment using that department’s Fund-Org account. Fax a copy of the the general ledger statement to Risk Management showing the department has paid for the repair/replacement after the transaction has posted.
